利用帮助客户调理身体、出售量子产品的机会，大力宣传“维卡币”是第二代虚拟货币，以高回报为诱饵，通过众筹、直接出售等方式吸收180余人投资1662万余元。近日，海南省海口市中级人民法院二审作出维持一审原判的判决，以犯集资诈骗罪判处刘某言、黄某枝、刘某瑞3人有期徒刑13年至3年不等，并处罚金。
2016年起，刘某言从黄某枝处接触“维卡币”，并向黄某枝购买“维卡币”，成为黄某枝的下线会员。
2017年，刘某言成立海南某健康管理公司后，利用帮助客户调理身体、出售量子产品的机会，宣传“维卡币”是第二代虚拟货币，即将开源上市，以上市后会有巨大升值、高回报为诱饵，诱惑他人以投资赚钱为目的，投入资金购买“维卡币”。
2016年至2022年期间，刘某言以口口相传等途径传播、介绍、推广他人购买“维卡币”，通过众筹“维卡币”的方式大量吸收不特定群众存款。其中，刘某言通过欧某春收取众筹“维卡币”资金435万余元后，将231万余元转给黄某枝，由黄某枝在网站上购买“众筹包”的“维卡币”。
除此之外，刘某言还通过鼓吹维卡币具有升值空间，直接向朋友、客户出售自己持有的“维卡币”吸收存款，其中金额较大的有：被害人张某惠以298万元和江西省庐山市一套房产、海口云龙镇一栋别墅房产向刘某言购买66万余枚“维卡币”；被害人李某燕以35万元的价格购买7万枚“维卡币”；被害人梁某敏以100万元的价格购买20万枚“维卡币”。
刘某言在吸收不特定群众的存款后，与对方签署“维卡币”《托管协议》，并帮助对方在“维卡币”网站上注册账号，注册账号时需向黄某枝购买“激活码”（激活码分5个等级，价值在1078元到几十万元不等）激活账户。
刘某言的儿子刘某瑞于2019年开始向黄某枝学习，并帮助刘某言为新会员在网站上注册账户，同时帮助刘某言将云龙镇一栋别墅房产从张某惠处过户刘某言名下。刘某言、黄某枝等人将收取的资金大部分用于个人挥霍。
一审认为，刘某言、黄某枝、刘某瑞以非法占有为目的，使用诈骗方法非法集资资金1662万余元，用于个人挥霍，数额巨大，其3人的行为已构成集资诈骗罪，应予依法惩处。法院作出判决，刘某言犯集资诈骗罪，判处有期徒刑13年，并处罚金70万元；黄某枝犯集资诈骗罪，判处有期徒刑8年，并处罚金50万元；刘某瑞犯集资诈骗罪，判处有期徒刑3年，并处罚金10万元。宣判后，黄某枝不服提起上诉。
海口中院认为，原判认定上诉人黄某枝及原审被告人刘某言、刘某瑞以非法占有为目的，使用诈骗方法非法集资1662万余元，其行为已构成集资诈骗罪的事实清楚，证据确实、充分，适用法律正确，定罪准确，审判程序合法，驳回上诉，维持原判。
